Terms of Services
PLEASE READ THE FULL INFO/TERMS
These terms of the commission "Project" are between you the "Client" and myself the "Designer". The Designer retains the right to modify these terms at any point.
(Feb, 8th, 2023 edit: These terms are currently being edited and changed! In reading this, you understand that some information will be changed, removed, or expanded on. These current terms are mostly for pixel art illustrations or animation, NOT custom-made, personalized video game commissions.)
General Info

Prices can change based on the project details, number of sprites, characters, animations, etc.

Send me reference images and sketches of what you want!

Commissions are digital files sent through email, DropBox, or WeTransfer.

Personal use only unless previously agreed upon. Commercial, for-profit commissions fall under commercial use. See section: "Commercial Use Agreement" for more details.

Game Jams Related: Commission and artwork made intended for game jams, similar types of projects, or basically: "I'm using these sprites/characters/designs to make a game with," can fall under game development and commercial use, especially used for any type of passive or in-passive income. See the section: "Game Development and Design Agreement" for more details.
The Designer WILL NOT DO*

I do not consent for my work to be made, used, or sold for "nft/blockchain" anything. You will be put on a "blacklist" if you do.

No gore, suggestive drawings of/for minors (in real life or characters), *fetish-themed art, highly suggestive art (nsfw).

No things that are racist, xenophobic, homophobic, transphobic, or any other "ist" and "phobic" pretty much, lol.

I am flexible on the following:

Fanart - I don't usually do fanart, but I am not against it! Fanart just isn't my main area of expertise.

*Fetish-themed and/or nsfw works: I retain the right to deny any work I am uncomfortable with making. But I'm not 100% being at least asked.

Timeline
-
Commissions can take up to 2-3+ weeks based on my workload, the project, client communications, and the unexpected (aka life).

The Client will be kept updated as the project progresses, and the Client will keep the Designer updated on any changes to the commission.

Revisions are currently complimentary. But, any major revisions past the final art sent, and/or animation phase can cost $15-$30 extra, or more, depending on the revision(s).
Payment and Invoice

Please make sure you have the proper funds for the commission. See the "Holds" section for more details.

I accept payments through PayPal in $USD. Please use a currency converter for accurate pricing.

After we have a conversation about your commission and your commission is accepted, you can pay in full, or you must deposit %50 of the Base Price before I start on your commission. You will receive the final work after you pay your Final Balance.

The Final Balance can change if you request any additional work, or if you reduce parts of your commission.
Holds
-
There is a 1 week grace period if a commission already has a deposit, but the Client may need to wait for funds for the final fee. Please communicate accordingly.

If there is no communication from you, the Client, after 2–weeks about making your next/final payment, you will be put on a "blacklist", and your commission will not be worked on, and you may not use the artwork in any way.

Commissions put on Hold will be put on a "frozen list" and will not be worked on.
Refund Policy

Art isn't like an item mass-produced in a factory that you buy at the store; I am putting all of my time and energy to create a unique, custom-made piece for you.

If the commission is completed (but not limited to: the Client is sent the final files, the work is marked as completed, the final invoice has been sent, etc), refunds will not be granted.

If the Client decides to pay the full price of the commission but then cancels it as it is being worked on, The Client will pay for the work created up to that point, and be refunded the remaining payment.
Termination and Cancelation

If you decide to cancel your commission as it is being worked on, the Client is not allowed to use the artwork any way.

Using commissioned artwork for blockchain/nft related is immediate grounds for termination of this agreement, and the Client is not allowed to use the artwork any way.

The Designer and Client are both allowed to cancel the commission at any time for any reason; given or not given.

If the Designer cancels the commission before it is completed, the Client is permitted to ask for a refund. The Client is not allowed to use the artwork any way.
Designer's Use of Commissioned work

Once completed, the Designer retains the copyright over the designed artwork.

I am allowed to use the commissioned artwork in my portfolio and social media with my watermark.

If the commission is to remain private, let me know in the first conversation.

If you want to remain private, but the commission can remain public, let me know in the first conversation.

If the Client request the commissioned work be made private, within reason–from the Designer's social media and portfolio, inform the Designer as soon as possible.
Commercial Use Agreement

Prices and terms are for personal use only, (social media icons, banners, printing the art yourself as decoration, gifting it)

The "Commercial Use Agreement" is for things the Client would make passive or in-passive monetary profit/income with. This includes physical product designs such as stickers, clothing, bags, pins, charms, and books. Cover for an illustrated book, album, song, and/or audio track; digitally or physically.

Video formats such as streams and YouTube used as alerts/intros.

Depending on the usage, the "Commercial Use" fee is at least 2x the original price.
Game Development and Design

Game development is usually longer-term, and more detailed contractual work that can fall under Commercial Use, even if it's a personal project/game.

This can include; creating character sprites, environmental design, level design, gameplay design, UX/UI design, animations, and more.

The general range for a Game Development project starts at $800 and goes up not limited to: the project's intended use, details, scope, lifetime, platforms, etc.
